Let’s start with politicians
Our forefathers well understood the corrupting power of political office. Not only do politicians corrupt themselves (by giving into temptation), others seek to corrupt them through bribes, blackmail schemes (such as Epstein’s honeypot scheme), etc.
For those reasons, politicians can rarely be trusted, especially career politicians. The default position should be to NEVER trust a politician. The rare politician who can be trusted is no longer a politician but a statesman.
Moving on to constitutions
What is the point of establishing a Constitution, under our compound constitutional republic form of government?
The point is for We the People to declare our equal rights and the frame of delegated government by which those rights will be protected/secured for all.
That’s it. There is no other point.
Why the separation of powers (executive, legislative and judicial) in that Constitution?
To prevent corruption.
To provide for checks and balances in the exercise of the People’s delegated power.
To keep delegated government on the right track, which is protecting our rights.
Centralized power is too easy to abuse.
Decentralized/divided powers are supposed to check each other.
Unfortunately . . .
. . . it rarely works that way. Politicians don’t want to rock the boat because they want to stay in power. So they end up serving each other rather than holding each other accountable to serve We the People who (allegedly) put them there. Serving as a check on the abuse of power takes courage. Courage is in rare supply these days. Even in the sheriff’s office. (I’m getting ahead of myself.)
What about the great defenders of our Constitutions, the judiciary?
Judges are about as oblivious to our Constitutions as anyone. And as susceptible to corruption. Don't put too much hope or stock in their decisions. Their decisions are wrong and overturned all the time. Take a look at the 1857 Dred Scott decision by the Supreme Court that affirmed the right of one man to own another man. That should provide all the evidence you need to know that court decisions shouldn’t be accepted at face value.
Our courts have been hijacked by a corrupt, self-serving, money-loving Bar association. Lawfare abounds. It’s a good thing they don’t have their own enforcement arm. But then again, with such wimpy/corrupt executive branches, what good is the separation of powers? Frankly, it’s not good for anything, especially when you have cowards like Ricketts and Pillen and Hilgers and Evnen in charge.
What we need is a revolution, with new provisions for securing our rights. We can start with forcing legislators to reconcile all bills with our Constitutions before they hit the floor, ridding ourselves of central banks and fiat currency, breaking up all private monopolies–including land monopolies, stopping corporate lobbying, stopping insider trading, monitoring and restricting outside income while a person is in office, term limits, etc., and last but not least, restoring real elections.
Sheriffs
Now that we understand the point of a Constitution, let’s move on to a certain local “sheriff” who is more of a politician than a sheriff.
When “covid” tyranny hit the streets of the City of Lincoln and Lancaster County (Nebraska) in 2020, “Sheriff” Terry Wagner went scrambling for excuses to NOT do the job We, the people required of him by virtue of his oath and his taxpayer-funded salary.
As you can plainly see above , Wagner solemnly swore that he would “support [and defend] the Constitution of the United States and the Constitution of the State of Nebraska, against all enemies, foreign and domestic.”

The Constitution of the State of Nebraska, written by “We, the people,” plainly states that we have “certain inherent and inalienable rights” (life, liberty, the pursuit of happiness, etc.) that “shall not be denied or infringed by the state or any subdivision thereof.”
I repeat, “shall not be denied or infringed BY THE STATE OR ANY SUBDIVISION THEREOF.”
The Constitution of the State of Nebraska also plainly states, in the same Article (Article I-1), that the purpose of government (which is by our consent) is to “secure these rights.” NO exceptions. NO emergency exception clauses. NO denials or infringements by the state or any subdivision thereof.
Now then, as I was saying above, when in the Course of human events, the rights of “We, the people” to “life, liberty and the pursuit of happiness” came under attack by domestic enemies/terrorists in 2020 . . .
. . . by way of a “covid” narrative . . .
. . . in other words, when our Constitution came under attack . . .
Wagner not only failed to come to its (our) defense . . .
. . . he allowed a lesser political subdivision wannabe dictator (Mayor LGB-airdon) and her puppet bureaucrat “health” director (Lopez) . . .
. . . to dictate to him that he should treat his fellow citizens (who presumably elected him) as second class citizens and deprive them of the livelihoods that were essential to their life, liberty and pursuit of happiness.
In other words, instead of fighting against a couple of weaselly domestic enemies of our Constitution, as his oath required, Wagner prostrated himself before them.
And to add “icing to the cake,” while Wagner was prostrating himself, and restricting the livelihoods of We the People (in blind obedience to Bairdon’s order), he continued drawing his own big, fat, taxpayer-funded paycheck (as did Bairdon and Lopez).
It doesn’t get more treasonous.
We the People are the sovereigns in this compound constitutional republic.
Wagner, Bairdon and Lopez work FOR US, not the other way around–and certainly not for each other.
Wagner was supposed to be our line of defense.
Instead, he betrayed us.
Adding insult to injury
And if all of that wasn’t enough, Wagner then proceeded to add insult to injury by justifying his betrayal with a terribly written paper wherein he effectively took back his oath by saying he wasn’t a constitutional sheriff!
(That was a fine time to tell us. Please stop and read his paper here. It’s very short. I was going to quote it, but decided it would take up too much valuable response space. I’ll just address key statements below.)
Wagner claims he’s not a constitutional sheriff because our constitutions don’t mention sheriffs
That is simpleton reasoning at its worst.
The office of county sheriff didn’t need to be mentioned in either of our Constitutions (Nebraska or U.S.) because it predated both. The office of county sheriff has a long established history in this country that goes all the way back to the mid 1600s.
Concerning the Territory of Nebraska in particular:
Several counties predated our first Nebraska Constitution (1866) and our statehood (1867). Despite not having a Constitution, those counties secured the law enforcement services of a county sheriff. They didn’t need a Constitution or a Legislature to tell them they could do that. All they needed was common sense. The right to protect ourselves is a God-given, inherent and inalienable right that predates any Constitution.
Wagner should have read his own Lancaster County Website:
"In 1861, Louis J. Loder was appointed the first sheriff and county clerk of the county [Lancaster]. The first elected sheriff of the county was William Pemberton in 1863."
Last time I looked, 1863 came before 1866. This is just one example. Douglas County’s first elected sheriff came even earlier.
Wagner claims our constitution gave authority to the legislature to establish the office of county sheriff, in Article IX-4.
Wagner couldn’t be more wrong. He totally misconstrues the meaning of Article IX-4.
The only thing Article IX-4 did was give the Legislature responsibility for standardizing “THE ELECTION OF such county and township officers as may be necessary.”
The office of county sheriff had obviously already been deemed "necessary,” by common sense. Other officers could be elected as deemed necessary.
When Article IX-4 mentions “consolidation,” it is referencing population size as a factor in deciding the necessity of electing other county officers.
What’s funny about Wagner’s claim regarding Article IX-4
Article IX-4 wasn’t even part of our Constitution until 1875! Wagner totally misses the boat. We had sheriffs long before then!!
Wagner quotes his oath and then claims: I am sworn to support and defend the Constitution of the United States, and the laws and Constitution of the State of Nebraska, not to interpret it. I take that oath of office very seriously.
“Not to interpret it”??? What kind of nonsense is that??
What’s there to interpret??
Assuming it needs interpretation, how do you “support and defend” a document you can’t interpret??
Wagner is speaking out of both sides of his mouth, in more ways than one.
He just got done quoting Article IX-4 of our Constitution and acting like he knew what it meant. Now he’s saying he can’t interpret it.
Incredible.
(The fact that he totally misconstrued the meaning of Article IX-4 is beside the point.)
Wagner says: when I googled “constitutional sheriffs” the definition given means they enforce constitutional law over all else . . .
Duh. The Constitution is the supreme law of Nebraska.
Of course sheriffs have a duty to support and defend the Constitution over all else. That’s the point of his oath. (God help us.)
Wagner says: "constitutional sheriffs" believe that sheriffs are the highest governmental authority and that they have the power and duty to defy or disregard laws they deem unconstitutional.
That’s right, Terry. Your job and your oath actually require you to think, not blindly obey.
Our Constitution makes it very clear in Article I-1 that “the state or any subdivision thereof” can become subversive of our rights, hence the prohibition against denying and infringing upon those rights.
Terry, your job is to protect us from enemies within and without, while we pay your salary.
You haven’t been doing your part. We want a refund.
What is a constitutional sheriff?
A constitutional sheriff is every sheriff who takes an oath to support and defend our Constitution, and the God-given, inherent and inalienable rights of the people therein, against all enemies, and then follows through on that oath.
There is no other kind of sheriff, except the one who is a traitor, because he won’t follow through.
Wagner says: I also find it interesting that Constitutional Sheriffs pick and choose which issues they feel are unconstitutional.
Constitutional sheriffs don't arbitrarily "pick and choose" which issues they feel are unconstitutional.
Constitutional sheriffs know what the God-given inherent and inalienable rights of the people are because they actually read and study our Constitutions, and the history behind them.
Constitutional sheriffs defend the Constitution by defending those rights and freedoms therein that are being violated, at the time they are being violated, or as soon as humanly possible.
Constitutional sheriffs use the Constitution as their Employee Handbook from We the People.
When our rights are being denied or infringed, constitutional sheriffs don’t tell us to go hire some high-priced lawyer to argue in front of some corrupt judge, who won't allow a jury and/or won't defend our rights in a timely manner. They fight for our rights then and there.
A constitutional sheriff is nothing more nor less than a sheriff who faithfully (and courageously) fulfills his/her oath, which is to "support and defend the Constitution of the United States and the Constitution of the State of Nebraska, against all enemies, foreign and domestic..."
Who are the "domestic" enemies our Constitution must be defended against
Anyone within our country, state or county who is hostile to our Constitutions and the "inherent and inalienable rights" they were designed to protect. This includes people (enemies) in both the public and private sector, i.e., both inside and outside government.
Our Declaration of Independence makes it very clear that government itself can become destructive of the very ends/interests it was instituted to serve/protect, namely our "unalienable rights."
Our Constitution also makes it very clear that government itself can be the problem.
Closing
The three most important words in our State Constitution are the first three: We, the people.
The reason our frame of government is set up so that the sheriff is the highest law enforcement officer in the county is so that We, the people can hold him/her accountable for doing the job we hired him/her to do, which is to protect county sovereignty, protect local self-governance and protect our freedom.
We, the people know that we hold the ultimate police power (see Article I-26).
Decentralization of government is critical to self-governance.
Decentralization of elections is critical to self-government.
Nebraska government no longer serves the purpose for which it was created..
It has corrupted and adulterated itself. It serves other masters.
We have a right to alter or to abolish it.
There is only one way out of this mess, and that is for We, the people to stand up, show up en masse, and take back control.
And not through elections. We don’t have honest elections, not when we aren’t allowed to verify that the public servant candidates we vote for are getting our votes.
No, this mess is not going to be resolved through our current “voting” process. That process is a complete charade. We can thank our corrupt Executive Branch, our corrupt Legislature, our corrupt Secretary of State office, our corrupt county election offices and our corrupt cowardly sheriffs for that charade.
None of them are doing the job We, the people are paying them for.
We, the people are the sovereigns.
Our Constitution was written BY us, FOR us.
Our God-given, inherent and inalienable rights were enumerated first for a reason.
Those rights cannot ultimately be denied or infringed by any act of the executive branch, or the legislature, or the courts, or any political subdivision of the state.
A revival of Citizen Watchful is coming for traitors.
It appears Wagner doesn’t have the heart, mind, spirit or body to do the job We, the people, elected/hired him (presumably) to do. He will have to go, along with all the other traitors. If he doesn’t want to read, study and understand our Constitutions, then he’s not fit for his job.
Being a sheriff requires more than being a slimy politician.

Thanks once again Robert! Coincidentally - as I was listening to KFAB while driving to Fremont for a"Win it Back" presentation on the cover up of the Election stolen by electronic machines and software, .... , plus "HAND COUNTING" Ballots in Nebraska - Emery Songer, mentioned the Jan 6, 2020 "....crowd, ...? and The Constitution???! I couldn't help calling in to disagree with what I THINK he was saying! I'm not sure he knows which side to be on!
I bragged that at age 81,...., I believe I "Understand" the Constitution better than he! Here's the thing! Trump was still President - until 1/20/21, and under the "Separation of Powers" the President, not Congress, nor the Capital Police is the CIC. He requested troops and was rejected by them - that was the "Insurrection" - not to mention that ......, etc.
Even George Washington,...., used troops to quell "Insurrections", riots, ... etc. Pelooosi, Schuuumer, and their Keystone Cops, ... would have been executed in the old days! Can't get more "Compound than that Mr. Songer! So there!
Robert, thank you for the very well thought out post. I have been counting on reforming our election process to get back to one day in person voting counted by hand at the precinct level. Until then we have NO other options.
