A “quick” note here. (I’ve been working on a scathing rebuke of Evnen and his treatment of our elections for the last three days. Hopefully I’ll have that ready in a day or two. For now…) I wanted to share some correspondence I’ve had with the SoS office that culminated today:

Dear Secretary,
You are on the record as having investigated our elections for fraud. November 2020, in particular, stands in question. So does every election since.

On behalf of We the People; in the interest of holding public servants accountable; in the interest of educating the public; and in the interest of preserving our Constitutional Republic, I am hereby requesting, pursuant to Nebraska Public Records Law § 84-712 et seq., the following:
—a digital copy of the report that documents the details of your investigation, since November of 2020.
To be clear, I am not asking for a copy of any existing "rebuttal" of any so-called arguments of election fraud. I am asking for a digital copy of the report that details the investigation you personally initiated, launched and conducted, and your findings.
Nebraska Public Records Law requires a response time of four business days.
Your service and assistance are greatly appreciated.

I got this reply on May 6th:
Dear Mr. Borer,
This email is regarding your records request received by our office on Monday, May 2, 2022, in which you requested certain records from us under the Nebraska Public Records Statutes, Neb. Rev. Stat. §§ 84-712 through 84-712.09. Specifically, you requested the following:
—a digital copy of the report that documents the details of your investigation, since November of 2020.
Due to the broad nature and extensiveness of your request and the workload of our office, we cannot fulfill your request within four business days. The earliest practicable date for fulfilling your request is June 13, 2022. We do not anticipate assessing a cost to provide the records you requested. This amount may change once we begin the search process and determine how many records we have and what documents we must review. As with the cost of fulfilling your request, the time frame for response may change as we go forward with the search process.
Pursuant to Neb. Rev. Stat. § 84-712(4), you may choose to modify or prioritize the items within your request in some fashion.

And then I just got this reply late this afternoon:
Mr. Borer,

Colleen,
That's pretty funny. We both know that's not what I asked for. If this is your answer to my request, why did you delay sending it for over a month when it already existed at the time I made my request?? We both know Evnen was lying when he said he had conducted an investigation.

One more thing, since I have your ear…unrelated to the above, but still election related. This will be quick.
My local election commissioner denied my request for a copy of the tabulator CVR report. He maintains it doesn’t exist. So I came back at him with this today:

Pursuant to Nebraska Public Records Law § 84-712 et seq., I am hereby requesting the following from the Lancaster County May 10th, 2022 Primary:
A digital copy of the digital file/s that contain/s all of the scanned and captured digital images of all of our tabulated ballots.
Digital tabulator files are public records just as digital email files are public records.
