legislation that collides with the People's frame of government is null and void

Dear Friends,

The “frame of government” to which all government rule-making (executive orders, legislative action, “health” measures, etc) must comply is the People’s Constitution:

Preamble. We, the people, grateful to Almighty God for our freedom, do ordain and establish the following declaration of rights and frame of government, as the Constitution of the State of Nebraska.

We mentioned Article I-22 of We the People’s Constitution yesterday:

…there shall be no hindrance or impediment to the right of a qualified voter to exercise the elective franchise.

This exact language has been in our Constitution since 1875.

We all know that “elective franchise” refers to the People’s right to choose their own representatives.

The question is, what did the mechanics of that “election franchise,” look like back then, in the minds of the People?

Did it look like a secret computerized tabulator?

Did it mean a secret computerized tabulator?

Did it include a secret computerized tabulator?

These are all rhetorical questions, of course. The answer to each is obvious.

The authors of Article I-22 obviously envisioned a manual system of voting and a manual system of counting those votes.

Moving on to Article VI-6, which was revised in 1971.

It was revised from:
”All votes shall be by ballot.”
…to:
”All votes shall be by ballot or by other means authorized by the Legislature whereby the vote and the secrecy of the elector's vote will be preserved.”

Say what?

“…or by means authorized by the Legislature whereby the vote and the secrecy of the elector's vote will be preserved”???

What the heck does that mean?

Well, let’s go back to the legislative documents that promoted and supported the change and see if we can find out.

The first document is this one titled INTRODUCER'S STATEMENT 0F PURPOSE.
Quoting:

The following constitute my reasons for this bill and the purposes which are sought to be accomplished thereby:
. . .
Section 6 currently provides that all votes shall be by ballot. The new language would permit other means for the electorate to vote as authorized by the Legislature provided that secrecy be preserved. (emphasis mine)
. . .
The general effect of this bill is [among other things] . . . to provide for alternate systems to voting by ballot . . .

“alternate systems to voting by ballot”?”

Again, what the heck does THAT mean??

Let me take a stab at it. It means anything a bunch of stupid/corrupt legislators can come up with, that’s what.

It’s not good sign when the primary person testifying in favor of the change to We the People’s Constitution was from the Secretary’s office: “Ralph Englert, Administrative Assistant to the Secretary of State.”

I’ve started calling this type of activity “government incest.” Instead of the separate branches of government serving as checks and balances on each other, and serving We the People, they’re all in bed together serving each other.

Where were all of We the People testifying in regard to this change?? …and asking what the new language meant??

Sure, We the People had to vote on the change (assuming the election was honest), but a slick salesperson can sell almost anything. And there were other changes made to Article VI at the same time that were perhaps used as bait.

So who was behind this terrible change to the People’s Constitution, besides the Secretary’s office?
Good question.
The “Committee on Constitutional Revision” behind this change was chaired by Senator George Syas out of Omaha, who spent 26 years in the Legislature, and was hailed by the press at the time as someone who “demanded that laws have constitutional precision.”

Hah! What a joke. I’m betting the Omaha riffraff who were behind this change were looking down the road for a way to cheat in our elections.

Remember. “ES&S” essentially came into existence just a few years after this change took place.

Quoting Emerald Robinson:

In 1974, a young man who worked at a printing company named Robert J. Urosevich had a history-altering realization: the optical mark reader machines being used to score standardized school tests (quickly by the thousands) might have other applications too. Thus was born in the brain of an otherwise unremarkable salesman one of history’s worst ideas: could these machines also read an election ballot?

The fact is, we don’t know what this added language to Article VI-6 meant to its authors. (We have to assume the worst, until proven otherwise. That is what the practice of “Watchfulness in the Citizen” means. We don’t trust their intentions. We judge their actions and the results.)

BUT, we DO KNOW what the language of “elective franchise” meant to its authors. As I said above, it meant MANUAL voting and MANUAL counting.

Change isn’t always good. Computers don’t belong in elections.
