Law Professor and prosecutor extraordinaire David Clements will be speaking at Elevate Church, 8251 Pioneers Blvd tonight, May 15th at 6:30 pm.

I sent Sheriff Terry Wagner a special invite last night. Here’s what I said:

As I read through our State Constitution (annotations) and Revised Statutes, I find that common law is "everywhere" assumed, and hence, by extension, so is the position of sheriff.
We codify common law in general terms in NRS 49-101:
49-101.
Common law; applicability.
So much of the common law of England as is applicable and not inconsistent with the Constitution of the United States, with the organic law of this state, or with any law passed or to be passed by the Legislature of this state, is adopted and declared to be law within the State of Nebraska.
...but we don't define it. And nowhere in Nebraska law do we find the creation of the position of sheriff. It simply comes with the common law system.
Statute does define the basic duties of a sheriff—quoting NRS 23-1701.02:
23-1701.02.
Arrests; keeping the peace; duties.
It shall be the duty of every sheriff to apprehend, on view or warrant, and bring to the court all felons and disturbers and violators of the criminal laws of this state, to suppress all riots, affrays, and unlawful assemblies which may come to his or her knowledge, and generally to keep the peace in his or her proper city.
...but again, this is standard common law stuff.
The role of sheriff has a long history that predates the Magna Carta (see paragraph 2 here) and finds a prominent place in Blackstone's Commentaries (see quote from Chapter 9, paragraph 8 below), which for some time served as the basis for the study of law in America.
Here is a quote:
As the keeper of the king's peace, both by common law and special commission, he [the sheriff] is the first man in the county, and superior in rank to any nobleman therein, during his office[p]. He may apprehend, and commit to prison, all persons who break the peace, or attempt to break it: and may bind any one in a recognizance to keep the king's peace. He may, and is bound ex officio to, pursue and take all traitors, murderers, felons, and other misdoers, and commit them to gaol for safe custody. He is also to defend his county against any of the king's enemies when they come into the land: and for this purpose, as well as for keeping the peace and pursuing felons, he may command all the people of his county to attend him; which is called the posse comitatus, or power of the county[q]: which summons every person above fifteen years old, and under the degree of a peer, is bound to attend upon warning[r], under pain of fine and imprisonment[s]. But though the sheriff is thus the principal conservator of the peace in his county, yet, by the express directions of the great charter[t], he, together with the constable, coroner, and certain other officers of the king, are forbidden to hold any pleas of the crown, or, in other words, to try any criminal offence. For it would be highly unbecoming, that the executioners of justice should be also the judges; should impose, as well as levy, fines and amercements; should one day condemn a man to death, and personally execute him the next. Neither may he act as an ordinary justice of the peace during the time of his office[u]: for this would be equally inconsistent; he being in many respects the servant of the justices.
Law enforcement (keeping the peace) belongs to the executive branch. The sheriff is the county's chief executive officer and peacekeeper, elected by the People, accountable to the People and responsible to serve the People.
By way of his oath, the sheriff stands between the People of his county and anyone who would try to deny or infringe upon their God-given rights, whether they come from the State, or a subdivision thereof, or the private sector. Quoting Article I-1 of our State Constitution:
Nebraska State Constitution Article I-1
Statement of rights.
All persons are by nature free and independent, and have certain inherent and inalienable rights; among these are life, liberty, the pursuit of happiness, and the right to keep and bear arms for security or defense of self, family, home, and others, and for lawful common defense, hunting, recreational use, and all other lawful purposes, and such rights shall not be denied or infringed by the state or any subdivision thereof. To secure these rights, and the protection of property, governments are instituted among people, deriving their just powers from the consent of the governed.
We the People would stand firmly with you in protecting our rights.
But our rights must also be protected by honest (transparent and verifiable) elections.
My Invitation
My cordial invitation to you is to come hear an award-winning law professor and prosecutor talk about how criminal our "elections" are and why so many people are so upset about them.
This professor will be speaking at Elevate Church Monday evening the 15th at 6:30 pm. If you come, I'll personally make sure you are not bothered in any way. I highly encourage you to come hear what the people of your county are so upset about. No one understands and can explain the problem better than this man.
The church is just a facility for conducting the lecture. You'll be comfortable.
If you decide to come, call me and I'll meet you and escort you to a place where you can listen without being bothered. It would mean a great deal to your constituents if you'd come and listen.
