I just fired off the following to our legislative and executive branches, after testifying before a legislative committee yesterday afternoon. More on that to come.
Subject: Emergency action required. Our tyrannical SoS is breaking the law.
Senators,
Our SoS office is breaking the law. Emergency action is required.
NRS 32-1201 explicitly states that the cost of elections for county, state, and federal governments shall be a county expense.
By buying very expensive (but very cheaply built) vote-counting machines at state expense and forcing our counties to use them, our SoS office is breaking the law. Payment confers ownership. What our SoS office has effectively done is hijacked our county elections. And in so doing, they have turned our overall inexpensive decentralized manual-count county-controlled elections into very expensive centralized secret-software-counted state-controlled elections. This is a crime.
It gets worse. Our SoS's cheaply built machines are totally hackable. So it goes without saying that nontransparent, unverifiable, secret-software machine-counts, conducted by a private company with a financial stake in the outcome of the election, are highly and morally problematic. Especially when our SoS office insists on depriving citizens of access to the machine audit data. Secrecy in vote-counting reeks of fraud. Never mind Bena's so-called manual audits. They don't do anything to disprove fraud. Machine software can easily be written to skip over certain precincts while manipulating the rest.
That's not the end of it. Our SoS office won't allow citizens to monitor and vet our online digital voter rolls. People in other states around the country with constant access to their online digital voter rolls have found that those voter rolls are being stuffed before an election and unstuffed afterward. The reason is obvious. To change the outcome of the election. Our SoS office refuses to provide a list of voters who voted in a given election, so citizens can reconcile their "election/consent checkbook" by comparing the number of voters with the number of votes cast. This is on purpose. Again, they don't want us to find fraud.
Citizens and their county representatives are not in control of their own elections. This is criminal on the part of our SoS office.
The conclusion of the matter is this. Our SoS office is in violation of Article I-22 of our Constitution. They have made themselves a high level hindrance and impediment to the right of citizens in Nebraska to exercise their elective franchise. Voter rolls belong to the People. Elections belong to the People. Elections are the consent of the People. Article I-1.
We would save tens of millions of dollars by giving counties back their elections. But more importantly, we would save ourselves from a civil war. It would mean a little more work for our counties, but that's what we pay county employees for. Never mind that the object of conducting an election isn't speed but accurate and verifiable results.
Bena and Evnen are imposing their laziness and corruption on everyone else. It must be stopped.
We need emergency action from the Legislature to return elections back to the People. High stakes football games end peacefully because referees "audit" their calls and everyone can see the multiple replays.
If the right call isn't made, with transparency, in an election near you in the near future, this state and nation could very easily descend into a civil war or worse, and it will be your fault.
